Background

This is the ranked choice vote for the GPCA to take a position Proposition 36: Three Strikes Law. Repeat Felony Offenders. Penalties. Initiative Statute.

The choices are to rank 'endorse', 'oppose', 'no position' and/or 'abstain'. Delegates can rank as many (or as few) of these options in their order of preference.

An 'endorse' vote would mean the GPCA would endorse Proposition 36. An 'oppose' vote means the GPCA would oppose Proposition 36. A 'no position' vote means the GPCA would not take a position on Proposition 36. An 'abstain' vote means the voter is not expressing a preference, but is voting to help achieve quorum. Any of these position that receives 2/3 after all preferences are transferred is the position of the party. If neither 'endorse' nor 'opposes' receive 2/3, the GPCA's position will be 'no position'.

"Revises three strikes law to impose life sentence only when new felony conviction is serious or violent. Authorizes re-sentencing for offenders currently serving life sentences if third strike conviction was not serious or violent and judge determines sentence does not pose unreasonable risk to public safety. Continues to impose life sentence penalty if third strike conviction was for certain non-serious, non-violent sex or drug offenses or involved firearm possession. Maintains life sentence penalty for felons with nonserious, non-violent third strike if prior convictions were for rape, murder or child molestation.

Summary of Legislative Analyst's Estimate of Net State and Local Government Fiscal Impact

"State savings related to prison and parole operations of $70 annually on an ongoing basis, with even higher savings -- up to $90 million annually -- over the next couple of decades. These estimates could be higher or lower by tens of millions of dollars depending upon future state actions. One time state and county costs of a few million dollars over the next couple of years for court activities related to resentencing of certain offenders.

"A YES vote on this measure means: Some criminal offenders with two prior serious or violent felony convictions who commit certain nonserious, non-violent felonies would be sentenced to shorter terms in state prison. In addition, some offenders with two prior serious or violent felony convictions who are currently serving life sentences for many nonserious, non-violent felony convictions could be resentenced to shorter prison terms."

"A NO vote on this measure means: Offenders with two prior serious or violent felony convictions who commit any new felony could continue to receive life sentences. In addition, offenders with two prior serious or violent felony convictions who are currently serving life sentences for nonserious, non-violent felonies would continue to serve the remainder of their life sentences."
